Australia’s self-proclaimed ‘most controversial burger chain’ will open in Wollongong on Thursday.

It was only two weeks ago that news filtered through that Down N’ Out was being sued by American burger chain In-N-Out.
But the Sydney-based burger chain is far from down and out, with operators Hashtag Burgers capitalising on the “increased hype” to expand its operations.
Down N’ Out will be taking over the bistro at Hotel Illawarra for a minimum of three months, from May 3.
Down N’ Out creative director Ben Kagan couldn’t comment on the legal bun fight, which may take more than a year to be resolved, with a court date pencilled in for June 2019.
But he was happy to talk up the decision to choose Wollongong as the location for the popular burger chain’s third store.
“We've had our eye on Wollongong for awhile actually,” Mr Kagan said.
“We've been coming down to Wollongong for the last couple of years. It is a growing area. It is the type of people who are really into what we are doing.
“It should be good. It should be fun.”
Mr Kagan is confident Down N’ Out will be in Wollongong for more than three months.
“Hotel Illawarra just want to see how it goes but I’m confident it’s going to work well and we will be here for the long haul,” he said.
Mr Kagan was also confident people will “love” the burgers.
“Our basic menu is fantastic. We use quality ingredients such as Wagyu beef and freshly baked buns every morning,” he said.
“Then there is our world-famous weekly specials and infamous death sauce which contains a mix of three of the world’s hottest chilies.”
The Wollongong store is the first of 10 Down N’ Out will open around the country in the next year.
